HOUSTON–(BUSINESS WIRE)–A jury in Philadelphia handed down a verdict of $3.5 million on December 6 after a 16-day trial and nearly two days of deliberations. Plaintiff Kelly Martel was represented by John Boundas, partner at Williams Hart & Boundas, and Scott Frieling of Al Stewart, PC, Walt Cubberly, Margret Lecocke and Conor Cathey of Williams Hart & Boundas, and Rosemary Pinto of Feldman and Pinto. Ms. Martel used Ready-to-Use Roundup from 1998 through 2014 at three different locations. Ms. Martel’s verdict follows four other Plaintiff verdicts against Bayer in the last few months, with many more cases on the horizon. The scientific literature continues to build against Bayer, showing that glyphosate, the active ingredient in Roundup, leads to an increased risk of non-Hodgkin lymphoma, the type of blood cancer Ms. Martel was diagnosed with in 2020.
Ms. Martel fought through her diagnosis, treatment, and recurrence the same way she persevered through two depositions and a 16-day trial. She was relieved when the jury came back with a verdict in her favor. Ms. Martel’s case moved quickly under the Philadelphia Mass Tort Program, which Williams Hart & Boundas originated earlier this year with Philadelphia lawyer Rosemary Pinto and other firms representing Roundup plaintiffs. «I’m very pleased that the jury is sending a message to Monsanto to stop putting dangerous products that hurt people on the market,» Ms. Pinto noted following the verdict. This victory is a product of impeccable teamwork by our nationally recognized attorneys and leading scientific experts.
