Law Firm of Cerri, Boskovich & Allard Sues San Francisco Waldorf School, Tutoring Company for Alleged Sexual Abuse of Two Former Students

SAN JOSE, Calif.–(BUSINESS WIRE)–In a lawsuit filed by the law firm of Cerri, Boskovich & Allard in San Francisco County Superior Court, two women identified as Jane Doe 1 and Jane Doe 2 allege that they were victims of childhood sexual abuse while they were minor students at the San Francisco Waldorf High School. The lawsuit names the San Francisco Waldorf School Association, One Smart Kid, LLC, and alleged perpetrator and former teacher Jason Davis as defendants.

This complaint details a pattern of alleged sexual abuse by Jason Davis, facilitated by institutional negligence on the part of both the school and the tutoring company, resulting in the abuse and assault of the two plaintiffs.

According to the complaint, during the 2001-2002 school year, while Jane Doe 1 was a sophomore, Waldorf arranged for her to receive tutoring from One Smart Kid. The tutoring company assigned Davis as her tutor. Davis allegedly used his position to groom Jane Doe 1 on the Waldorf campus, holding sessions in isolated classrooms, discussing his personal sexual experiences, and initiating inappropriate physical contact. The grooming escalated to sexual abuse, which occurred on Waldorf school grounds.

The complaint states that after an incident where a school administrator found Jane Doe 1 disheveled with Davis in a secluded area, Waldorf failed to investigate or report the matter to authorities. Davis continued to abuse Jane Doe 1 throughout her junior year.

Waldorf offered Davis a part time teaching position the following school year. He then allegedly groomed Jane Doe 2 in 2003-2004, which led to numerous sexual assaults.

The lawsuit accuses the school and the tutoring company of negligent hiring, supervision, and retention of Davis, despite warning signs and opportunities to intervene. It also claims the institutions failed to report the abuse, even after Jane Doe 1 disclosed it years later to a teacher.

«This lawsuit isn’t just about the past; it’s a critical call for all educational institutions to rigorously vet, supervise, and act decisively to protect students,” attorney Mark Boskovich said. “When that duty is breached, the harm to the victims is lifelong and demands redress.»
