This Thursday, May 7, 2015 at approximately 11:00 am, five individuals will appear at the San Ysidro, CA port of entry and request humanitarian parole. Their requests are based on emergent familial concerns and for family reunification.
The above named individuals desperately must be reunited with their families as they are all married to U.S. Citizen spouses and have U.S. Citizen children. Each of them (four of them through counsel), have prepared and will present detailed packets highlighting the extreme, emergent hardships their U.S. Citizen families face. Their spouses and children have been mentally and adversely affected by their absence.
Pursuant to the federal regulations, and INA 212(d)(5)(A), the Secretary of Homeland Security is authorized “in his discretion to parole into the United States temporarily under such conditions as he may prescribe only on a case-by-case basis for urgent humanitarian reasons or significant public benefit any alien applying for admission into the United States.”
INA 212(d)(5)(A). The Secretary has delegated his parole authority to USCIS, ICE, and CBP. To be clear, parole is a discretionary authority, and does not constitute an admission into the United States nor does it convey any benefits to the beneficiary. One common type of parole request is family reunification, and other emergent requests depending on the facts of individual cases. FAM 42.1 N4(e). Finally, parole is not meant to circumvent normal visa issuing procedures. Id at (f).
Each of the above named individuals is an ideal candidate to receive a grant of humanitarian parole. They have each practically exhausted all legal means of reunification with their families. We therefore come together with these U.S. Citizen family members in unity and urge you to please grant humanitarian parole for the above named individuals. Granting humanitarian parole will provide these U.S. Citizen family members with the blessing of being able to live as a unified family in this great nation. A grant would put an end to their current ongoing suffering. We thank you for your consideration.
